At De Novo, Jonathan Edelstein and Daniel Solove make excellent arguments for abolishing the bar exam. (And don’t forget Clint Bolick’s article on the same thing some years ago.) Look, of course the bar is just protectionism. Some state bars change their passing score level when “too many” people pass. If the bar were about protecting consumers, that would make no sense. But the bar is not about protecting consumers—it’s about protecting those who have licenses against competition from those who don’t.
