The courts exist to put a check on the extremely dangerous power of the majority. Whenever anyone attacks the courts for violating the “right of self government,” what he is really saying is that the majority should have unstoppable power to do whatever it wants regardless of the Constitution. Such claims should be viewed with the severest skepticism, because it is only the Constitution’s limits that prevent us from becoming a government of the mob.
